Effective June 11, 2026, Washington law generally prohibits a broker from marketing residential real estate to a limited or exclusive group of buyers or brokers unless the property is concurrently marketed to the general public and all other brokers. The law includes a narrow exception when limited marketing is reasonably necessary to protect the health or safety of the owner or occupant.

That means the old idea of a brokerage-only pocket listing cannot be the default marketing plan. Public marketing does not require the seller to allow property access or showings, but it does require the opportunity to be marketed beyond a closed group.

What First Look adds

Beginning September 4, 2026, Northwest MLS First Look gives sellers a formal pre-Active status for up to 21 days. Every First Look property must be submitted to Northwest MLS and made available to all member brokers. The seller can choose IDX distribution and can decide whether showings occur during First Look.
